REGULATING THE USE OF THE X-RAY MACHINE OF BURGOS, ILOCOS SUR

Let it Be Ordained that:
SECTION I. RATIONALE. Article 25. of the IRR of RA 7160 provides that the Responsibility of the LGU in the Delivery of Basic Services and Facilities shall, in addition to their existing functions and responsibilities, provide basic services and facilities devolved to them covering, but not limited to, the following:
Municipality
(c) Subject to the provisions of Rule XXIII on local health boards and in accordance with the standards and criteria of the Department of Health (DOH), provision of health services through:

Implementation of programs and projects on primary health care, maternal and child care, and communicable and non-communicable disease control services;
Access to secondary and tertiary health services; and
Purchase of medicines, medical supplies, and equipment needed to carry out the devolved health services.

Likewise, Article 100. of the same, implies that among the Powers, Duties, and Functions of the Sangguniang Bayan as the legislative body of the municipality, shall enact ordinances, approve resolutions and appropriate funds for the general welfare of the municipality and its inhabitants pursuant to Sec. 16 of the Code and in the proper exercise of the corporate powers of the municipality as provided in Rule IX of these Rules, and shall:

Approve ordinances and pass resolutions necessary for an efficient and effective municipal governance, and relative thereto, shall:
(vii) Subject to the provisions of the Code and applicable laws, determine the powers and duties of officials and employees of the municipality; (viii) Determine the positions and the salaries, wages, allowances and other emoluments and benefits of officials and employees paid wholly or mainly from municipal funds and provide for expenditures necessary for the proper conduct of programs, projects, services, and activities of the municipal government; (ix) Authorize the payment of compensation to a qualified person not in the government service who fills up a temporary vacancy or grant honorarium to any qualified official or employee designated to fill a temporary vacancy in a concurrent capacity, at the rate authorized by law;

SECTION II. DEFINITION OF TERMS

X-Ray Machine – a diagnostic tool often used in medicine passing through objects or parts of the body and produced a photographic film
RLED- Regulation Licensing and Enforcement Division
RadTech- Radiologist Technologist
MHO – Municipal Health Officer

SECTION III. RULES AND REGULATION – The X-ray machine shall be provided as an indispensable medical tool for the provision of health services of the inhabitants of Burgos, Ilocos Sur. To attain this objective, the following rules shall be observed:

No certificate of indigency is required
Patients who would be the subject for x-ray shall be the discretion of the Municipal Health Officer or upon the personal request/discretion of patient.
the x-ray machine and its housing shall be accredited by the Regulation Licensing and Enforcement Division (RLED).

SECTION IV. X-RAY OPERATORS.

A Job Order position for Radiologist Technologist (RadTech) shall be made available until such time when funds for a permanent RadTech position shall be allocated. The RadTech shall perform the following duties:
a. set the appropriate technical factors based on the examination and patients body thickness.
b. provide good quality x-ray image.
c. properly position the patient based on the physician’s request.
d. protect the patient, other personnel/health care workers by administering ALARA (As Law As Reasonably Achievable) radiation and by using protective shields and proper collimation.
A Radiologist shall submit the result of his reading/interpretation within two to three days to the MHO of Burgos, Ilocos Sur.

SECTION V. MEDICAL SUPERVISION OF A CLASSIFIED XRAY WORKERS ON RADIATION AND OTHER HAZARDS- All designated and classified worker shall be subjected to medical supervision by the Municipal Health Officer (MHO). In this case, a satisfactory medical examination and training is required before commencing the work.

SECTION VI. FEES AND CHARGES – (a) Every person who wants to avail the services of the x-ray machine shall pay at the Office of the Municipal Treasurer the amount of one hundred forty (P140.00) pesos only, per plate, to be entered as Trust Fund for the maintenance and purchase of supplies for the x-ray machine.

(b) Non-residents of Burgos, Ilocos Sur shall be accommodated in a case to case basis, as determined by the MHO. For this purpose, the client/patient shall pay, at the Office of the Municipal Treasurer, the amount of two hundred (P200.00) pesos only, per plate, to be entered as Trust Fund for the maintenance and purchase of supplies for the x-ray machine..

(c) In addition, a fee of fifty pesos ( P50.00) shall be charged by the MHO from client for the reading or interpretation of the x-ray result. The amount of P50.00, however, will not be charged if the client decides to personally consult his/her own radiologist.

SECTION VII. EFFECTIVITY. This ordinance shall take effect after its approval and signing.
